This question is a tricky one, as negative SEO is not a specific criminal offence as such. However, it is possible that, in future, the police may attempt to prosecute negative SEO under section 3 of the Computer Misuse Act 1990.
i definitely wouldn't recommend relying on Black hat SEO techniques as they can do you more harm than good. In order for someone to able to make some results with it, it would be necessary that he or she are highly experienced, although even in that case it could be too risky. On the other hand, I don't really see the point in it, of you want to achieve good ranking on long run you should rely on proven methods that will really bring some quality and valuable traffic to your site.
Negative SEO is not a good practice to do. If you want permanent ranking of your website then don't use the negative SEO. There are, of course, more sophisticated types of negative SEO, building "legitimate" low-quality backlinks over long periods of time. But these campaigns are quite expensive to organize and they are hardly ever worth it.
