Unfortunately it's exactly how the law works in the United Kingdom, and it's working towards being like that in the United States with changes in a number of states (including NY and CA).

The key change is that the onus is put on the accused to prove consent (which can almost never be done) instead of the standard innocent before proven guilty approach where the lack of consent has to be proven. This is being called "affirmative consent" and "yes means yes" in a typical PR/propaganda play.

The incentive structure that this sets up is pretty interesting. For one, it provides men with incentives to record every single sexual encounter they ever have.

You quoted my post (above) and responded to it, wrongly assuming I was speculating on my friend's potential reaction to a girl falsely accusing him of rape.

If I'm incorrect, are you saying he shouldn't "get over excited over somebody" who rapes him?

no its not how law works. in dubio pro reo is a foundational assumption of judicial process. if thats not how your courts work, you live in a lawless state.

i find it fascinating how easily terrified men are by the mere idea of girls actually having an instrument to retaliate against them. poor boys gonna cry.

I'm fairly certain the concern isn't honest, honorable women having a form of protection. The concern is whack-job bitches who make false accusations being given free reign to destroy the lives of others.

I agree that being falsely accused of rape sucks, but planning out a murder is not a mature way of handling it. Two wrongs don't make a right bud. Maybe when you grow older and wiser, you'll understand.

and just out of the kindness of my heart, if you ever get falsely accused of rape, how about you just claim you werent even there. dont admit to having had sex, just say you werent there. thats still their job to prove. better yet, dont say shit. let the lawyers do their lawyering and walk.

- I'm pretty sure my friend would feel the same.

My mention of my friend was in the context of his being raped, not falsely accused of rape. I can't put that in any simpler terms.

she actually created this video according to her memories, hired an actor and re-enacted the whole scene. This video proves nothing, as it is directed according to her words, and was created only as an art project to express her point of view.

How can you prove she is lying, based on this video?

He did follow up with saying that it's better to not say anything and just lawyer up instead. Ultimately this is what has to be done. You need to stay silent and have your legal counsel do the talking. We can all surely agree on that.
