People are such fucking losers. They need to copy your site because they can't come up with an original idea, do their own research and testing, and execute it on their own.

First thing you should do is DMCA the fuck out of his Hosting account and try to get control of his domains. I'm sure you can put together the evidence so it's warranted. If the guy is a moron, losing his hosting account may be all you need to do.

You should also get your boyfriend to track him down and kick his ass.

Am not advocating the guy or his douchebaggery, but it's the OPs mistake in the first place for getting in a guy, let alone a neighbor in her business in the first place.

I mean, getting some help is one thing, but letting him handle your stocks, talk to your suppliers, know your profits, your business model, your marketing plan is just asking for a kick in the groin.

All this without an official contract and no profit sharing is even more retarded.

As far as the DMCA is concerned, that would work only if the guy has copied her sites word to word and frame by frame. And using a similar public domain template won't count. Also, if he has merely rewritten product descriptions, that wouldn't deem fit for a DMCA notice as well.

There are plenty of loopholes when it comes to DMCA filings and eCommerce and if the guy is so hell bent on making her life miserable, am more than sure that he'd have taken extreme steps to protect his own ass by now.

To the OP,

What I'd recommend is going full monty on the guy. Market your business and innovate like crazy.

As guerilla said, you have to start doing what he's not ready to do.

Setup multiple sales avenues, open up new websites without any connection to the old ones except for maybe the CRM.

Lower your prices, increase your products. Talk to Niche blogs and forums. Discuss.

Setup a 24 hour complaint resolution premise. Most importantly, reach out to your existing customers.

And lastly, SPY on your neighbor. Maybe get one of your girlfriends to hook up with him, steal his source codes and business plans and hand it to you. Like they do... IN THE MOVIES! :cool2:
 
I agree with Guerrila, i think wasting time on revenge is futile.

Infact i'm unsure why Guerilla even 'liked' Cheshires post because in my opinion, doing what he said ^^^ is about the worst thing you could do, because it'll make no positive difference to your business and is purely an act of revenge and frustration that'll only make matters worse for yourself.

If someone started pouring oil on my driveway and fucking with my car, i wouldn't back down, i'd quadruple my efforts to destroy them.

Think smart. Not with your emotions.

I don't see it necessarily as revenge, but just fucking with your enemy. When your enemies head isn't in the game he's losing. If you can keep his mind pre-occupied with fear, doubt, or just make him lose sleep, it's much easier to beat him. People are creatures of habit and when you break up someone's routine it takes them a while to re-adapt to the new routine. If his routine changes daily or weekly he'll never be able to adapt.

Maybe vandalizing his car is a little too far but you can get very creative without destroying property. When his mind isn't in the game he can't beat you. He stops worrying about what you're doing and starts worrying about what's going to happen to him next. This plan works even better if he really does have something to hide.

You can do a lot of things anonymously and he'll never know it's you.

A trick that works well in cases where the number of suppliers is limited, and you have deeper pockets than the competition.

Sell at a price that's low enough to drive huge sales, even if you have to sell at a small loss. Do this for however long it takes your supplier (the one you share with said jackass) to notice the volume.

Call supplier and negotiate a contract where you get a price 5% lower than anyone else. In writing. ( Offer minimum sales/month as a carrot if needed )

Raise price to where you have a 5% margin, wait for competitor to fold.

Raise prices back to where they were.
