Costello likely found Grunin after the NY Post article (as well as many lawyers trying to get his biz)
This was never some grandiose stalling tactic, Grunin genuinely thought Costello would get him off.
As has been mentioned above, the new lawyers are doing basically the only thing they can do. I'm not certain whether it'll be granted or not, but personally my guess is that it will be denied and the default upheld for 2 key reasons:
1. It would give precedent and ammo for others deciding to try Freeman tactics to waste the court's time and annoy their opponent and then switch back to a real legal defense at the 11th hour. Granting this motion essentially rewards Grunin since it'd have given him further time. Nobody should be rewarded for using a clown like Costello
2. The evidence extortion line from Costello. If Grunin, as he says, has no legal knowledge and just listens to his advisors, it's quite clear that from that declaration there's a decent chance evidence was destroyed. The potential for evidence destruction is pretty clearly causing prejudice against Facebook if granted.

It won't matter if it gets upheld or not - mgrunin will just be delaying the inevitable. He'll either be paying a lot of money to Facebook or a lot of money to Facebook and a lot of money to his lawyers.
Let's not forget that Grunin continued to have Costello send shit to the court after the motion. He's summarily fucked. 22yo and a leper. The time to act was prior to the default. Calling the lawyers child molesters. Excelsior! Bravo!

Sorry poopie, I hate to disagree with you, but I think the default judgment will be set aside and Grunin will be allowed to defend himself. I once had to sue somebody who then later defaulted and the defendant had their default judgment set aside with ease by the Judge.
However that will just delay the inevitable, because there's no way for Grunin to win this lawsuit. The evidence against Grunin is overwhelming, and Facebook knows it.

Opinions. I gave you mine. Yes, it's generally a simple matter to get a DJ thrown out; especially when the summons is at issue (third-party delivery, etc). The guy admits to receiving it. He hired Costello and continued to file bogus docs with the court, even after being admonished with the ruling, only to send the crazy 8/7 filing. He signed all the docs and hinted at hindering the discovery. Attempts to extort the court.
There is no legal basis to toss it out, but as all things go (in court), it's the judge's call.
Normally I would agree, but he's gone too far here. We'll see.

There was a bit of discussion as to why the judges keep throwing out their cases, and it was decided they were using the wrong seals. They recently went to Staples to get a new one made for all 50 states- one seal "to rule them all". Once they get that one, the judge will have no choice but to rule in their favor!
