BIG TROUBLE with Epic/Azoogle !!

Hey, I've Generated $4,348 with Epic during Dec 21-24 while running a Dating Campaign, it was a split test between 2 dating offers, my manager at Epic-Todd Stearn then sent me a mail that the advertiser of one company wants to charge back the complete amount without any warning because he felt that other company reference in ad copy would harm their brand image,and after negotiations it was decided that he would not charge me back if I run that offer again after getting my ads approved, but then Ive been charged back 1/3 amount ($1200 approx) and he still insisted that I run the traffic with them again...I didnt.

Today, I See that my payments have been freezed with the email that reads :


"Hey Subhan,

I hope you saw my last email. The advertiser is going to charge back the rest of the leads you generated on this offer unless you run it again. I know you want to leave our network, which is fine I guess. If you want to preserve your leads just run the offer with us for another week or so. That way you can make some money, preserve the money you made, and then leave our network as you had planned anyway. If you don’t get back to me soon the chargebacks will be put into place.

Now I have about $3,322 pending with them and a mail that is forcing me to run the traffic with them. I dont feel that it is reasonable to charge me back the complete amount just because the ad had a different company reference( I agree that it isnt the good practice but it was just a split test ),I have never being into this issue with any other network that I have worked with even though Ive been earning about a $50-70k/month.

Any suggestion on how can I proceed in this matter, im really confused, is it because Azoogle had changed to EPIC or is it Just because of my manager??

Is it reasonable to chargeback the leads just because of different company reference without any warning during a split test..im very sure that, that specific ad copy had run for hardly a day?

can you give an example of the adcopy?.. you dont have to out it specifically, just how it was used in the adcopy.

Also, what are the terms of the offer? if they arent stated that you cant mention other company names, then i believe you should be entitled to your money. Then again, there is a bunch of legal shit involved that i dont (and 95% of affiliates/wickedfire) doesnt have a legitimate grasp on. a lawyer should understand this situation better.

It really sounds to me that the advertiser is using this situation to come out with free leads. They obviously want you to keep pushing their offer since you were making them money. They came up with this proposal believing that you'll accept it for sure, and they'll keep an extra $1,200 in their pocket.
 
advertiser fucks epic-they try to fuck with you. Is your AM your friend or u just talk to him once in 6 months? Trust me being a close friend with ur AM helps in these situations.

You know in Azoogle there is an attention block with any offer, right in offer details.

Like , you just said , you were just doing a split test and the fact that the advertiser wants you to re run the campaign once again for them , i am pretty sure , the AM , Tord , is giving you a hard time and making all the charge backs!!! Otherwise , you would not have been told to RUN the campaign once again.

It makes sense that EPIC would be out of business if they practice business this way.

Anyone who actually makes money knows that 5-10% of monthly revenue is pretty fucking important and no one wants to see that kind of cash go away because either the advertiser or affiliate network are being unreasonable.

Just because 50-70k sounds like a lot of money to you doesn't mean people roll over and just let 3k fly out the window, or they never would have gotten to the point of making that kind of cash.

I was running with be2...and was split testing smartdate, and refrence was..."Only at be2.com " in the ad copy...

I mentioned all services right...and used the term be2.com in the ad copy...so if be2 was the trademark...it should be be2 which who should be messing with me, what does smart date has to do about it ?
What I mean is, they should be understanding that there is a split test going on..im just crying foul over the chargebacks....

sean3, I read lot of terms of offers, big number of them asking not to use competitors trademarks (urls, etc.) too. Cause you promote smartdate, but be2 see this...and be fucking smartdate, which smartdate don't want probably!

Hurr-durr, there was dude with Neverblue lately in something like that situation, also he was paid back 50% of earnings. Number were 5 times bigger.

Hannah, sometimes I fight for 15$ wire fee which some other unknown stupid middle bank charge in the process for quite a sum of the earnings, but...still can't believe in that:) Probably cause it's his first case of that.
 
Thanx seolinker...but the promotion was done for just 4 days in total.which means, that..according to azoogle(Sorry, EPIC)...the affiliate is given 48 hours to make the changes as directed by advertiser..this provision is given for similar situations.direct chargeback is not the answer..they should understand that it was just a split test between 2 campaigns..a warning would have helped..also, its not about the amount, but the unprofessional ism the company shows towards the affiliate..

Theres your fucking problem man. I know your intention isnt wrong but the method you're using does have grounds of not getting you paid. This is plain wrong if you're using Be2 in your ad copy & sending traffic to SmartDate (doesnt matter if you're split testing). Be2 will object on using their name to drive leads to smartdate, and smartdate can reverse you're leads cuz you are 'misguiding' users to signup for them using Be2's brand name.

OP said he was earning 50-70k a month, not netting. The 3-4k he might be out could be a large part of his after tax margin per month. I make it point to collect every dime I have earned because after expenses, tax, etc.. it all counts.

Don't run again for this advertiser man or atleast not via azoogle.. Why don't run via EWA , they Pay more than azoogle's street payout.

One thing for sure is that , It's your AM or Azoogle who is eating your money and not the advertiser... With the rep of Azoogle , i am sure they WILL take their money from advertiser with 100's of reason from their end.

earning for me = netting cause that all it counts in the end, probably I am thinking further cause pay lower taxes no matter what income, flat rate.
