I think they would have charged him, but think about it, the jury is likely to be sympathetic....then there's the stand your ground law that's on his side [even though he defended himself excessively by firing 8 shots].....why waste tax dollars on a prosecution that's not likely to succeed?
 
8 shots is absurd. Guess it was midnight + not sure if the guy had ever actually shot the gun in self-defense before (probably hadn't). The combination of being scared shitless and adrenaline may have contributed to the insane amount of shots fired
 
Running with a gun is dangerous, that thing can blow your Johnson if you don't fix it well.

As for the attacker, well, he was aware that he's going to hurt someone and might well get some in return. This was a bit over the top but it's his fault.

Examples:

she should have been yelling at the guy trying to break in or maybe even fire a warning shot
Could she have at least yelled, "I have a gun!"?

I'd probably shoot him in the legs or something though, I'd injure him enough so he couldn't do shit, but not die...

Yes, there are hundreds of possible scenarios.

"Oh, the jogger should have just wounded the guy. No need to clip him."

"Why in the world would the jogger have been running with all that money? Sounds fishy."

"Running with a loaded firearm? The jogger was obviously looking for trouble."

"8 shots?! EIGHT??!! One into the brain stem would have been fine. In fact, one round through the left atrium would have put him out of commission, and given him a chance to survive. EIGHT?! YOU MONSTERS!"

The reality is that your average person will not even remember pulling the trigger multiple times in a life threatening scenario.

I hardly call a punch from an 18 years old a "life-threatening scenario". Plus if the guy is a jogger he must be in a good physical shape, he probably could have kicked the shit out of that kid, or at least just threaten him with the gun first, before shooting 8 fucking times. I don't know man... this jogger just doesn't seem right in the head. Too many weird factors in this story.
 
Anyone here who actually owns a handgun will know how fast you can pop off 8 shots.

I have a 10 shot clip for my semi-compact XD-45 and I'm frequently like "Oh I'm out already?" when speed shooting. And that's not even factoring in the adrenaline dump that has already been mentioned. Someone is fucking attacking you at midnight HELLO!

Also keep in mind that the person was only hit 4 times.

I'm not saying that there isn't more to this story, but the "eight shots is excessive" theory is lame to me.
 
I wasn't there/don't know the story.

But it was midnight.

He only hit him 4/8 times. He may have just been punched in the face, but if he didn't see it it could have been a bat or a lead pipe for all he knew.

Good chance he was shooting at a dark figure, he probably couldn't see much.

On the other hand, the theory in the second version of that story, where the family thinks it was a setup by the witness... That's a possibility too.

Given what I know...

Attacked in the dark. Thought he saw the kid reach for a gun. Being threatened... I think it's justified. And so is popping off 8 shots.

he has the right to fire until the threat is eliminated, 8 shots or 50, he has a right to protect his life. maybe the kid just wanted his wallet or maybe he wanted more, we don't know. However, we do know that he was willing to attack a stranger for a few dollars, and probably more given the chance. Don't want to get shot, don't rob people... very simple. The mugger lost his protections as soon as he initiated the violence.

Yeah, when you consider that it does sound fishy. Maybe they had some sort of deal going on there... Guess it's too late to ask the "robber" what really happened and we'll just have to go with "innocent" jogger's story :D

I grab my money clip every time I leave the house whether I am going to the mall at noon or out for a walk at midnight because it has my ID in the middle.

Self defense is one thing, but he proceeded to continue to shoot the guy after he turned away.
