It was only a matter of time before Harpo took action, affiliates really should start getting more creative and stop ripping each other's ads/copy/landing pages. Yes you can still get a good CTR without using Oprah and yes you can still get a 10%-15% conversion rate without having to use flogs, review pages or "endorsed by Oprah" in your ad copy.

On a side note, I didn't realize Illinois had so many affiliates ;)

This suit seems to be about as targeted as possible.

They are going after Facebook affiliates, arguably the most high profile and controversial (as far as online exposure complaints) advertising medium for Acai blogs. Facebook is also probably the easiest source for personal affiliate information.

They are going after the 25 affiliates who spent the most.

They are going after affiliates who live IN Illinois.

They are going after affiliates not for rebills or fake blogs (although they may get prosecuted for fake blogs) but SOLELY because they used Oprahs face and name without permission.

This isn't the Illinois AG who is angry, this is Oprah and her lawyer who are angry because it DAMAGES and waters down her brand.

At first glance, these affiliates are going to lose. They are going to be forking over money. Oprah's lawyers most likely have an open and shut case and will "settle" for damages before this thing ever goes to trial, IMO.

But these 25 affiliates are in for a messy ride. God's speed. I hope them the best. Take it on the chin and keep on ticking.

Their has got to be some large affiliates in California and NY (and everywhere else), so I'm sure they are next.
 
So I was going to post in the thread that godspeed just put up about them wanting to "sue" him but Turbo locked it before I had the chance... but what he had posted are simply requests to remove references to Oprah and Dr. Oz. Nowhere in there is any reference to anyone getting sued or even subpoenaed for that matter. A simple bigfoot c&d letter at best.

Anyone who have been involved in civil litigation knows that you never want to do it again...unless you are a lawyer collecting the fees. It is a long and messy ride...and more money than you think.
 
It is long indeed, civil discovery process takes forever.. 2 years before you see a court room.

I believe to collect acai moniez Oprah has to show [either/both] damages and/or ill gotten profits from the use of her brand. She will have to spend serious $$ to get that done. I am doubtful she would pursue it, maybe thats why AG is now involved.

However, I can see Harpo making examples of marketers illegally using her brand. I mean shit, no one else in the world can make someone a millionaire in 2 minutes by saying 3 words "my favorite thing". Everyone here knows how powerful a thumbs up from Oprah is you have to know at some point the hammer is coming on those who used her brand without authorization.

That would be my concern, am I going to be an example. fuck shudders at the thought
