I'm about to go at someone who wrote me a bad check.

Here's some stuff I think I can get them on that I've gathered on. Some of the stuff I knew - like the employment status issue.



1. The bad check over $200 (I think this is a felony).

2. Having an office full of sales people at least 20-60 and they're all 1099 when he requires them to work set shifts, dress appropriately, and follow scripts. (they should be W2).

3. Screwing over their customers. (The owner also owns a "Loan Modification" company that charges up front fees and has left countless customers in his wake)

4. He always sets up the businesses in his wife's names even though he runs everything. I doubt he's forthcoming w/ his taxes

I'm a Shogun preparing for battle, so I'm asking the most vindictive& intelligent group I know:

Looking at a few of the variables what opportunities do you see?
 


1. It's only a felony if you can prove he did it deliberately and that the act was fraud. Even then I think you need the check to be over $500 unless you are going by state law.

2. If they don't get paid by the hour and work on commission only with no draw then they can be 1099.

4. He probably has an accountant sign off on everything so no. And running a business in your wife's name? A business is a separate entity to begin with and my guess is he runs an LLC where it doesn't matter who owns it since the taxes are figured separately. Even if he runs an S-corp under his wife's name it doesn't matter.

5. If I were him I'd send you a money order right for $250 because you only just started digging.

OP, receiving a bad check is horseshit, but instead of trying to ruin the guy, why not just move along? Yeah, I can appreciate that you don't give people bad checks etc, and that would piss me off too, but is it worth it? I don't know man. good luck.

Some people need to be used an example.

South Florida's business community is fairly small and everyone is generally two or three people separated.

Be ruthless.
 
I know it sucks but think of the negative energy accumulating in and around you? I mean some people thrive in revenge but its a double edge sword man good luck!

1. It's over $500. And I actually have it in writing that they meant to bounce the check while expecting the delivered product. They were trying to negotiate after the fact.

2. They have to be W2'd - especially considering their doing business under a "mortgage bank's" name.

3. Are you sure that you have someone else as CEO/President of a company on paper of a Corp then you operate everything yourself when that person has no involvement? I thoroughly understand corporate governance and it's one thing to protect liability and it's an entirely different thing to claim zero ownership or operational control when you really own everything.

Who the fuck knows what he's reporting to the IRS?!

4. His accountant was his mother until he fired her this summer for stealing from him. His mother, not his wife's...

5. When you're commission only there are certain things you don't have to do that he requires. Independent Contractor (Self-Employed) or Employee?

The guy sounds like a piece of shit that needs to learn a lesson. Fuck negative energy, this is karma at its finest. If the guy deserves it, bury him.

Not that I give a shit what you do. But if I knew you that'd be my advice too.

This was one job? You'll probably lose just as much $$$ in time spent trying to get back at him. And then dealing with the blow-back from it if he retaliates.

If it's about business and money I wouldn't waste my time. Just learn from it and move on.
 
Revenge is a dish best served cold. Put it on the back burner for now and after some time if you still feel the need to get even, hit him hard and he'll never know who or what hit him.
 
If the check bounced (he didn't stop it) then just report it to your local district/states attorney as fraud and then turn it over to your lawyer and collect triple damages plus fees (how it works in Illinois- most states are similar).

It's a simple legal thing, mate- no sense getting all worked up over it- file it and move on. A collection attorney shouldn't charge but a few hondo plus filing fees to collect that, and it fucks him up pretty well to boot.

Or, just take it as a lesson that checks are a BAD THING.
 
Revenge is unprofessional and stupid.

Pay a local attorney to write them a letter and give them a call telling them if they don't pay, you will sue them for _________ due to _________.

This approach has never failed me in getting paid fast. I've had naive non paying customers who bought websites/ppc services call me to apologize and create excuses after I've had an attorney contact them on my behalf.

After you cash a valid check from them you direct them to the paragraph in your agreement where it says "either party can cancel at any time" and you drop them as a client. This is your revenge that wont get you sued.
 
Burn the fucker. Every time you let someone fuck you over and don't get satisfaction you lose a small part of yourself and in the end you just become a carpet. Also assholes like that need to know that if they try the same thing again that there will be consequences.

Satisfaction is something that is worth much more than money (well unless you are paying for it ;) )
