Also, anyone know how some sites get away with using "Facebook" in their names/domain? I've seen some big sites doing this and getting away with it, don't know how though.

That's insane. I would be interested in hearing the opinion of mont or some other advertiser with a legal background. How far can Facebook realistically pursue this?

It seems reasonable that since they approved the ads that you have a reasonable defense in the event that Facebook tries to muscle you into something completely ridiculous. But then again, from my personal experience with some non-advertising related litigation, lawyers seem to operate outside of logic, reason, and human decency.

As others have suggested, you should probably lawyer up at this point. It's probably also not a good idea to continue posting details of this on a public forum, and maybe think about getting a moderator to remove this post to be safe.
 
If I were you, I'd ask a mod to delete this thread and speak to a attorney. I'd also not deal with FB in anyway for a while.

From what mgrunin posted, they are *not* actually pursuing the affiliate accounting info. Hell, they could have also requested that he grow his mustache back.

What matters is at the end of the letter - the deadline they gave in the C&D clearly stipulated they want to hear that he is going to discontinue using all facebook services, and that's it. If they get that by the 11th, they'll probably be satisfied.

With a C&D, the important part is at the end when they say you have until such and such date to do XYZ.

Give them what they want to get them off your back for now. And then return at a later date when you can do it as an entirely new entity totally unrelated to your previous account info. Choose your battles...this one's not worth "fighting" but instead walk away for now and come back later.

Additionally, I'm no lawyer or legal expert by any means but I'm pretty certain only a court (or IRS, or some other gov't entity) could force you to hand over your affiliate earning info. Facebook doesn't have that right. Which is why they are not demanding it of you.
 
If you don't receive a snail mail notice by Certified Mail, you're fine.

Either way, you should be fine because they approved your ad.
 
I got the same 2 months ago although my C&D was for different purpose. I did not responded to them but just stopped doing what that asked. After 10 days again got a mail by Ryan T. Mrazik | Perkins Coie LLP and again I ignored. again after 10-15 days got a funny mesg from Ryan at Perkins Coie:-

Facebook is becoming impatient with your failure to respond to its letter. Please respond immediately.

guess what? I never responded and now I again started doing what I was doing..

to the OP I don't think you need to much worried about it as sending a letter via email in no way can be obliged. Just don't respond to it!

yes by far if you get something physical letter at your home then I guess you should take it serious. Not sure where you reside but I don't think they can catch and sue guys out of United States (especially in countries like India where cyber laws are not strict)
 
There are no US courts that would recognize an "official email" from an attorney as a legal document. They can send you emails every day for the rest of your life and there is never any proof that you have received it.

Official legal documents have to either be served by a process server or via CERTIFIED US MAIL with your signature.
