TAMPA, Fla. – A pistol-packing jogger in Florida won't be charged for shooting and killing a teenager who attacked him during a midnight run.
Prosecutors said Tuesday they are convinced Thomas Baker acted in self defense when he fired eight shots at 18-year-old Carlos Mustelier near Tampa in November.

Prosecutors say Florida's "stand-your-ground" law was a factor in their decision. The law, passed in 2005, gives people the right to use deadly force as long as they "reasonably believe" it is necessary to stop another person from hurting them.

Baker told police he reached for his gun when the teen punched him in the face. Baker has a concealed weapons permit.

The teen was hit four times in the chest, back and buttocks. He died at the scene.

Awesome laws are awesome.

Agreed. They didn't mention whether or not the attacker had a gun. I believe in using equally deadly force against deadly force. I would have just kicked the guys ass and maybe stomped him out.
 
In Alabama if you come into my yard and steal my son's bike and I shoot you dead , your family buries you. End of story.

On the other hand if you get mad and slap your wife you get a night in jail. At your trial you get a hefty fine and sentenced to anger management classes. Second time you get a minimum of 30 days.

I believe that if someone threatens me with harm, then I am in the right to fuck their shit up in whatever I see fit - be it a gunshot to the chest or a bat to the head.

This is the risk you take when you go out at midnight trying to mug people out jogging. Maybe if more people reacted with deadly force, the shitbags would start thinking twice.
 
You people who say meet equal force with equal force just answer how you know the next thing after a punch in the face isn't a knife in the gut? In addition, by the time this fact becomes clear to you, do you still have time to pull your gun? Use a little logic.

That said; eight shots, holy shit...dude needs some trigger control or the attacker was a big bad MF. He's lucky because in another state that extra 4-6 rounds could have turned a good shoot into a life sentence.
 
If you are out jogging and are attacked, chances are you are not going to be able to defend yourself to good, especially if you are 3 miles into your drum. You are weak and your attacker has the advantage over you.

You guys talking about fighting back. Go run 5 miles and try to fight some one 4 miles into your run. If the idiot didnt want to be shot, he shouldnt have attacked the jogger. Glad he is dead.

Right, because when attacked you totally have the time to go through all the possible scenarios and variables. Never mind the fact that it's pitch black and you're being attacked by an unknown assailant, you should absolutely take the time to inspect him, frisk him in between beatings, and take your time to go over every possible inch to determine if he is a threat or not...because being attacked in the dead of night is not nearly sufficient to determine if you're in danger. Even if he is 6'4" 300 lbs and the guy is 5'10" 170...totally even for a hand to hand fight.

Or...criminals could just stop breaking the law and attacking innocent people, then they wouldn't really have anything to worry about.

I love my concealed weapons permit. And "Stand your ground" laws are awesome.
