it'll be interested to see how this plays out. there are so many parts of the law that come together in AM. im assuming that the AG can only go after affiliates for misleading consumers in their own states because the federal government has the right to regular interstate commerce.

I want to make sure I got this straight. 30 Super Affiliates ALL who live in ILLINOIS and ALL who promoted ACAI are under subpeona?

That's alot of super affiliates from one state if thats true. OR what is considered a "super affiliate" has a much lower level of entry than what I consider "super affiliate" to mean.

The reason I ask is two fold. First, its important to know if the Illinois AD is ONLY going after residents of Illinois. Second, what is the threshold? 1k/week? 10k/week? 25k/week?

And if they had all the personal information then, yes, it does sound like they had an informant(s). OR a network. That would make ALOT more sense.


Actually the any state AG can go after any affiliate any where if they think the affiliate has brought harm to a resident of their state. So all 30 may not be in the state of Illinois.

I'm thinking its because of the flog. Fake testimonials ain't "legal". Add in the fact that you probably got Oprah endorsing this shit (unknown to her). Great for conversions, not great for staying out of the line of fire.

The law is pretty specific about what counts as actual endorsement, and where the line of assumption is drawn. Such as having a video of one of her Doc Oz episodes could at best simply be copyright infringement (since using the video for commercial purposes might be a fuzzy line into 'fair use')

From an affiliate's point of view, I'd probably be more concerned about income tax issues than I would be about false advertising. That's what they often end up getting you for when their original cases fall apart.
