i have a website Eminem "Recovery" In Stores 6/21/10 Pre-Order Now! i haven't had any trade mark issues with it yet .. but i heard people saying that it could cause a problem .. i now want to buy another domain

Facebook - _________.com

do you think this will be red flagged more because it has facebook in it ? or should i just test it and try it out anyways ?

what are your thoughts?
 


As long as you're not directly competing with the company I don't think you'll have too many problems. I've got a few domains with trademarks in them and have not gotten a C&D yet.
 
Most trademark lawyers are old as shit and don't know anything about the internet. You can pretty much get away with anything you want concerning domains as long as you don't own trademark.com, or trademark.net
 
I got a letter from a celebrity once for using his name in a workout article that I ranked #1 for ... The only money being made off it was from adsense, but he still felt I was misusing his name for promotional purposes. I think it really just depends how anal that Celebrities Lawyer is ..
 
I'm getting a C&D for using a fucking logo on one of my sites.

The product I sell is "approved by _______" (and it really is), and has disclaimers that I don't own the trademark, etc

But these fuckers keep sending C&Ds..

Anyone else ever catch shit over a trademarked logo? Would it go to ICANN before my site gets shut down?
 
I've gotten C&D'd for having the name of a big restaurant chain in a domain. Wasn't much of a problem though, they said I had to transfer the domain to them but they funnily enough even payed me $20 to do so. (It was a shitty domain, so no I didn't get scammed).
 
one major health company came out with a new product line...so i randomly checked to see if it was registered..and it wasn't...so i took it..it took them like 6 months after they did all this promotion to realize they didn't own that domain. losers. but yea..C&D came in and i had to give it up to avoid any issues.
 
Here's the deal with trademarks. If you call your company Matrix Computers, and use all the green lines and cool matrix code shit, you can get sued. You're using their mark to benefit your business.

If you call your landscaping business Matrix Landscaping, and your logo is a green box, you're fine.

When a company registers a trademark they have to declare what they're going to use it for. Usually a movie or video game company will grab everything their lawyer thinks they can get away with. Merchandise, movies, books etc.

If you ever a hire a trademark lawyer to search a trademark usually all he does is go here: Trademark Electronic Search System (TESS)

And searches the mark. You can see who registered which marks and their intended use. If a trademark is listed as DEAD, it means that they company who registered the mark decided not to renew it, and you can re-register or do whatever you want with it.

That link is also a nifty tool to see what companies are coming up with in the future. Try looking up fun companies like Blizzard, Sony and Apple, you'll see some neat shit they registered and then abandoned.
 
Watch out with a domain with "facebook" in it, their legal team finds the domains quite quickly and will hit you up with a C&D very fast. I'd be more concerned by the facebook term then the Eminem term.

Agree with this. Get another domain name, and put Facebook in the title - the search engines will recognise what you are about, but you won't be breaking and trademark rules as Facebook won't be in the domain.

When did the idiots invade WF? eBay constantly has their lawyers send C&Ds on any domains with the word "bay" in it. You think Facebook won't try to fuck you up?

So basically, lets say there is a company called "electronicsonic". I will register a domain called electronicsonic10.com , and i will outrank him. Would that be on the safe side ?

Moreover, im not sure how clickbank and others are doing this, but basically Affiliates do an iFrame, and take one of their products, and place it on a Trademarked website, they use all the logos etc... On that case, who holds the responsibility or who can get sued, the affiliate or the network such as clickbank etc... ?
