What is the pic for the listing?

Is it an actual logo or just the text in plain black letters?
 


Words that are clearly descriptive can't be trademarked. I've tried registering trademarks like this before.

Based on what you sent me I think you're fine. From what I've read the only time tm is being violated is when a customer would be able to confuse the 2 different brands/products and your name is not similar to his at all.

There is nothing on TESS because it's too generic of a word to have a trademark on.
 
The penalties for willful infringement are significantly higher than when you're not aware of your violations. Him sending you a letter gives him the option to sue you in the future for a shitton more than he could sue you right away for.

Now the question is: Do you think he'd sue you? If not, then keep doing what you're doing. Otherwise, change the name.
