As you quoted yourself, " Gary also said that if you disavow bad links now or as of about two weeks ago, it will likely be too late for this next Penguin refresh."
so it's unlikely that any fresh links will be counted either. Google usually uses past data for those big updates so anything too close to the update won't count.
Unlikely that the fresh links will get caught in the update, means fresh links are good until the NEXT update... maybe another year down the road
