So I got a little girlsname'sweightloss.com site going. I'm a n00b and I didn't actually think I'd make any real money from it, but wanted to do a bit of a test.

I got one single conversion, about two weeks ago.

Today I get an email from the Washington State Attorney General's office, with a complaint from this one conversion. Seems she has not only not gotten any product, she has been billed for a ton of different products and shipping costs, effectively overdrawing her account to the tune of $400.

I'm all for making a buck from stupid desperate people, but this seems way over the top criminal.

Any lawyers in the group here, or anyone else have to deal with this? I'm pretty concerned atm, though I'm not really sure how I can be held accountable when I didn't take any money or promise anything on my own website or anything like that.

I'd appreciate a bit of feedback, if y'alls don't mind. They are 'requesting' a response within 21 days. What do I say to them? Thanks for any suggestions, helpful or otherwise.

That's one lead that wasn't worth it. Main reason why I wouldn't even consider promoting such a "product", no matter how much money it could make me.

Hope someone can help you with the legal specifics though, in any case make sure that you do reply to it within 21 days.

dude, for $400 they will totally extradite you. our economy is shit now. you know how many whoppers she could get with that money? A FUCKING LOT.
 
True he's in a different country but IF they were to go after him he'd have probs entering the US no?

This is not legal advice obviously but I'd point them to a terms of use on the site that states the site is for marketing purposes only etc etc and then point them to the merchant.
 
Reply back explaining that you are just an advertiser promoting X product through X affiliate network. You don't actually handle the transaction, yada yada.

How do you mean, Looney Tunes crazy? As in, I'm going to get a visit from some goofy hunter who think's it's FearsomeOrange season, or crazy in I'm going to get kidnapped and taken to WA state and thrown in the slammer crazy?

I am not liking this. Not one little bit.
 
Quit trippin and explain the situation. I don't think anyone here is aware of merchants running $400 charges on these things? Seriously, fuck that merchant that's ridiculous.

Just tell them you promote products etc and you had absolutely no knowledge that they operate like that nor do you deal with the handling of the transactions directly and you also have a disclaimer on your site stating the site is for promotional/marketing purposes only and you will not be held liable for anything that may or may not occur when the user makes the purchase and you are not responsible for anything once they leave your site. And again point them to the merchant, that's where they made their purchase.

If you're feelin brave send them to make monies.

Tell them you market a website with advertisers on it but you do not handle consumer transactions.

Its a form letter from someone going to the WA AG site and making a complaint.

I'd just refer them back to the merchant - dear AG, I think you may have sent this to the wrong address. This letter is complaining about xyz. That is run by acai ripoffco inc, here's their address....

They'll either FO and leave you alone, or they'll escalate by making an allegation. At this stage, don't give them any detail to use against you later on.

If they fuck off, great, if they escalate, speak to a lawyer.

They are going to come pick you up anytime soon. Probably going to be a bigger headache than anything else.

Give them the info to the merchant so they can contact them. Inform them that you aren't the product owner, etc,.

Also, keep in mind that just because you're an affiliate doesn't mean you aren't responsible. If you're pushing a product & people get hurt $$ wise, you are on the hook as well. Especially if you're running one of those blogs with fake testimonials.

In a previous biz someone contacted my states atty gen office on me. I spoke with them and resolved the problem. The issue was with a drop shipment that got lost in the mail & customer went straight to atty gen instead of calling me.

Imo, that's bad advice. Why point the states Attorney to your TOS? They've probably already seen it when the customer gave them your url when they filed the complaint. Also, you don't want to come across the wrong way. The ideal is the get them off of you, not looking deeper into your site.
 
I think the most amazing part of this issue is the fact that some angry fat skank actually remembered (bookmarked) YOUR site and while she has credit card charges and most likely an invoice with company/address/contact information in her fat hands, she chose to complain to the AG about YOU.
