The recent one was sent to one of the hosting companies, big ass one to. They gave me a chance to defend myself and correct the problem if I was in the wrong before they took any action.

I killed everything but have all the data stored for something I have in mind for later. ;)
 
Well, that sucks dude.

Also sucks for the people who purchased rights and licenses. Also sucks for people who resold the sites.

I guess it'd be my fault for not realizing the script was shady. I'm just waiting for the $xx,xxx in refund requests.

The software isn't the direct issue its the way its used, for example using the embed codes from YouPorn and other sites is the issue just using the software to create a video site is not the issue so don't be scared to use it just because I was using it incorrectly.
 
I'm not pissed at you, I'd stop it too after the C&D. I just have quite a few sites that I sold for a nice chunk of cash on the basis of being adult sites. I'm worried about what happens when they start getting C&D's and start asking me for refunds. Or the embed links get changed and their sites just quit working.

Someone break it down to me - can this script be used or not? Its the same shit as manually taking their fucking embed codes and putting it in a wordpress blog...

In other words, bend over. Ask nicely and maybe they'll be gentle.

Thing is - the new upgrade does exactly that - it uses the pornhub vids without changing the embed code...

Hot linking the images would be a problem though no?
 
Let me break this down for everyone the issue is that I was using pornhub and youporn video on the site, the software itself can still be used just fine if your using your own materials, videos, images, ect... that YOU OWN.

If you use it to display pornhub or other copyrighted material then its your own fault there is no issue with the exact software itself it was also because I was shipping the software with database files filled with codes from other sites this was a no no which obviously I stopped doing.
 
Aequitas, once again, I'm not pissed off at you. But the whole point of buying the script was if I had my own porn, I wouldn't need to purchase a license for the script along with the videos. The whole concept of the site (profitadults) was an easy to use script to start your own porn website.

I'm not blaming you. I knew it was scraping pornhub. I should have read the TOS before pursuing the projects.

Live and learn. I'm not bashing you here. I'm just frustrated with the situation (along with quite a few other people.)
 
in that letter it says that if you comply, his client "will not prosecute".

this is a civil matter, not criminal. unless the lawyer's client is a government body, they couldn't prosecute a moldy turd.

now, i'm just being nitpicky. if you're in the wrong and have their attention, you better clean it up. but i doubt that letter was written by a lawyer or even a lawyer's first year law student summer intern.
 
Ummm.. that's a pretty shitty looking letter, and the claims in it are pretty fucking outrageous. Quick question for ya.. Was it written on a law firm's stationery? Was the signatures on the bottom of the letter printed or signed by hand?

Before caving in to the demands of this person and his brilliant client, why don't you shoot back with a question such as asking for PROOF that you're infringing and how they came up with the $1M amount.

I could be wrong here, but copyright is not criminal in this sort of way, so it seems like more of a shock/scare tactic that they are tossing in so that you comply asap and don't question them.

Maybe it's worth your while or not, but I've ALWAYS questioned authority, especially from lawyers and internet tough guys/bullies. It doesn't cost much except for some time (if you don't use a lawyer). So why not test it out and see?

You know... you can just scrape the videos and host them yourself, because it's the leeching part that pisses them off. Of course there are lots of other shady ways to fight this and make it VERY tough for them to catch up to you, but it depends on how much you want to spend, in terms of time and cash. May or may not be worth it.

"Destroy the software" = what a joke.

If I were pornhub though, I'd be a hell of a lot more worried about the US Gov and the 2257 shit than some kid making a script to show more videos to the world using my servers. Although, on their part, they could just put together some changes to the video, like slapping their pornhub name all over it or encrypt the location of the video files, if they cared that much too. Probably cheaper than the cost of their legal fees to send out these C&D's all over the place.

Ah well, until you get physically served, your cherry has yet to be popped, but welcome to the C&D club. ;)

Yeah I'm not worried about it and I'm going to re-launch the site after I make some changes like remove there embed codes from the site and clean up some things then I will re-launch and if they say anything after that I can literally say fuck you.

Because when I re-launch nothing will be shady everything will be 100% my own legal work so if they want to fight my intellectual property rights then I'm all for it but right now I was displaying there videos using there embed codes so they do have something to bitch about.

Anyway the site will be back up by Monday with everything re-organized and re-worked out avoiding any and all possible copyright issues.
 
Any chance of compiling a database including videos that aren't illegal to stream, or even self hosted?

This may put out some potential fires. Just a thought.

I'm dealing with some very pissed off people right now. Again, not blaming you, but I'm about to lose a pretty good chunk of cash.
 
If I were in your situation I would contact as many adult sponsors as I could find. Show them your software and what it does and tell them that you need content to include in the software package. They will jump all over this and give you a shit ton of content from their networks. Host the content yourself, charge a monthly access fee to all of the people running your script, poof, problem solved.
