Surely though you stand a better chance of coming to some kind of agreement if you don't send completely retarded nonsense to the court.

At least the judge is less likely to be totally against you if you act somewhat reasonably and attempt to settle.

I also think it's pretty likely that he is completely broke right now and he literally can't afford a competent lawyer or a serious settlement offer even if he wanted to.

Only incredible stupidity and complete desperation could lead us to the hilarious shit show we're now witnessing.

The only option remaining in my mind (other than being an idiot, but I dunno...) is that Grunin knows he's fucked, but that if you're gonna go bankrupt getting sued by one of the biggest companies in the world, might as well have a story to tell while you're at it.
 
There's gotta be some law being broken by this guy. I mean he's charging money for legal representation in court. His product/services under "court" category include DUI, DWI, drug possession, etc..........

Correct me if I'm wrong, but he's not even allowed in most courtrooms, is he? Doesn't that require passing the bar exam, and having a license to practice law?

So it's actually, "As a Diplomat, Brian Costello can piss off your prosecuting attorneys by sending them complete garbage, including invoices of $1,000,000! He can't actually go to court with you though, so you're on your own for that one."

No, its just another term for power of attorney. Like when you were a little kid and your parents could represent you in court. He just signed power of attorney over to this guy. So now he is his "lawyer in fact". Just means he can show up or represent himself in court, pretty much self representation through a 3rd party.

That's my take on it anyway.

You can do a lot of things on behalf someone as if you were them with a power of attorney (access bank accounts, open/close bank accounts, sell a house, etc). After all a power of attorney literally lets you set into someone's shoes and be them in a legal sense like how you described.

But I think going to court to self represent someone on their behalf wouldn't fly with most judges. It might work in small claims court maybe.

I agree with your take in the sense that Brian Costello probably think he can just goto court on behalf of someone in the manner you described. He knows he can at least write letters on behalf of someone.

In the end as a convicted felon, I guess Brian Costello has nothing to lose. Even if he gets busted for practicing law without a license, he's probably already used to the jail house lifestyle. Brian unfortunately has a really poor understanding of the law and is giving bad legal advice; it blows my mind that Martin keeps deluding himself into thinking he's going to come out of this okay.



A really good "attorney in fact" would probably be a former real lawyer who was disbarred. But even then, that's still totally sub standard since you're dealing with someone who was not ethical enough to keep his law license.
