I would have mashed his head a bit more. But still, pretty cool that they stopped and restrained him.

Citizens arrest is kind of a legal gray area though and you're only allowed to do it (in Canada at least) if you see the crime occur. The guys restraining him here didn't see it they were just helping, so I wouldn't be surprised if the thief sued them for assault.

Its unbelievable that the thief could end up getting money if he decides to sue. Laws like this need to be changed.

Then what stops me from giving someone a beating and saying I thought they were stealing something, or I was defending myself, etc?

The point of rights is that all people have them; that's why you usually end up defending yourself in court to some degree if you are involved in a situation where initially you were the victim... Assault, etc. are still what they are even if another event (theft for instance) happened right before that.

So yeah, if you see someone stealing something how do you defend yourself/your possession without also opening yourself to legal liability?

Maybe dumbfucks in Canada would give the guy money but most courts would go like this.

Theif: Court, I'm suing because these guys hurt me.
Court to citizens: Why did you hurt him?
Citizens: He stole a computer. We were restraining him until authorities arrived. This suit should be dismissed.
Court to Theif: Lawsuit dismissed. GTFO

I still remember the famous San Francisco case in the 1980's where a burglar fell through a skylight trying to break into someone's house and landed on a knife left on the countertop... Then proceeded to SUCCESSFULLY sue the shit out of the homeowner, who wasn't home at all.

Or perhaps you'll remember the time when some football player killed his wife and her lover and got off scott free...
