I had a bad run in with a local company here that are basically a bunch of shady douchbags. I've had dealings with this company on both professional and personal (I know the owners) level, and they've pissed me off for the last time today. I won't go into the details on what they did, but I could really fuck them over with a www.their-company-Scam.com website. I would be using real testimonials from others who were also screwed by these people, and nothing would be fictional. This would rank well against their bullshit company and would really hurt their business.

My question is, would/could you get in shit for this? I mean could you get sued for defamation of character or could they file some sort of lawsuit if they found out who created this (obviously it wouldn't be that hard to find out)?

Anyone experienced in this sorta thing?

not a lawyer but any yahoo can get on ripoffreport etc. and post whatever with no real evidence to back their claims so why not..
 
Thanks fellas. I'm on the fence about doing it, my emotions are obviously telling me to go for it but I don't need any sort of legal repercussion headaches/bullshit. Getting sued isn't worth it, especially having to pay for a lawyer etc even if I were to win.

But it's just so easy to throw down $10 for a domain and to be able to go to town. Gotta love the power of the interwebs.
 
If you can back up your claims, don't sweat it. I have a douchbag ranked for some "child predator" related terms. As a direct result, he lost a sweet job and his life is pretty much fucked.

Just be confident. If you get a C&D from some schmuck attorney they hire - post it to your site. For extra laughs, mail back a reply written in crayon. And, post that shit on your site too.

Best case scenario:
They sue you. Seriously.
1. That's major link bait.
2. You can countersue for the money you spend on your attorney.
 
If you don't have anything to gain from it, I think you should just cut your losses and move on.

Even if you are doing nothing illegal, they can waste your time and money with junk lawsuits. They may also be able to get the domain if it has their trademark in it, not sure though.
 
Generally speaking if you allow other like minded people to post on your site, it becomes a portal of free speech for opinions and such, and they can't really go after you then. Look at sites like paypalsucks.com

You may just be being overly emotional, then again you may have quite the case for laying their lying, ass-raping, cum-sniffing asses wide out for everyone to get a chance to dig their boots in.
 
I put up a complaint site on Chase Bank about 2 years ago. I was threatened several times and ordered to turn over the domain and website. I can't remember my exact response, but it was something along the lines of "see you bitches in court". They eventually backed down when I pulled the blatant aff offers down. I still get donations on the site and some aff offers that are a little better hidden make a few bucks, but more importantly the site gets hundreds of visitors every day now and is a major pain in the ass to Chase. Site ranks #1 for a shit load of anti-Chase terms, but even funnier is that it is on page 2 for "Chase Bank" on Yahoo and Bing and page 3 on Google. Needless to say, they are not pleased which is all I ever wanted.

From a legal standpoint here is my advice:

1 - I would not call it a scam, as that can get you in hot water unless you can legally prove it. You can say they "suck" or whatever, since that is an opinion.

2 - Don't put ads on the site, since they can claim you only put the site up to make money off of their name. That doesn't mean you can't get creative, build a list to market to later, etc.

3 - Don't be skurred.

I'm no lawyer and anyway, laws differ from country to country but but from what I understand as long as you make it clear that everything is your opinion they can't touch you.

So be creative and write like a politician... "It is my personal opininion that ABC is a douche because on the alledged date they appear to have done stuff that may have contadicted a verbal agreement which the allegedly blah blah blah.

Posting real testimonials from real pissed of customers is (allegedly, in my opinion) perfectly legal - that's just being a reporter...

Thanks bro. The minute I put up this thread I thought about that site you did a few months ago. Some good tips there, lol @ skurred. I'll see if I can get the testimonials from the other people and will probably put something up.

Anyways, let's just say we hired a nanny to take care of our kids. Our neighbour has a nanny agency here. We were gonna go through them (back when we were on friendly terms), but after getting to know some of the nannies from seeing them outside, they basically told us that this agency is running a sweatshop within their place. These filipino chicks apply to their agency to come here from the Philippines (dirt poor as fuck), and when they arrive the agency puts them up at their place until they can find them a job. Let's just say the agency doesn't try that hard to find them work, and basically makes them work 12-14 hour days without pay to cover their living expenses. We had nannies show up on our doorstep with their luggage in hand crying because these fucks treat them like dogs. We also found out that this agency also charges an extra placement fee (which is illegal), so they basically scamming them out of a few extra hundred denairos or so. So obviously my testimonials will be from these nannies.

Once the agency saw that these nannies were coming to us crying (we took them in overnight so they could go and stay with relatives the next day etc), they basically blamed us for all their problems. The douchebag owner thinks that we planted thoughts in their heads on how negative they're being treated? Like WTF?

Anyways, I have some other personal stuff that's totally pissed me off (they're trying to fuck with us out on the street etc) that I'd rather not put here in case I actually go through with this and don't need a WF thread coming up in court to haunt me.

It out ranks them for their own business name and the names of each of the business owners on Google, Yahoo and MSN. Every now and then they threaten me, but nothing ever comes of it. The site has a disclaimer at the top that basically states the obvious: that the site simply expresses my opinion and my personal experience with them. Not a damn thing they can do about it.

That's messed up. Have you tried reporting it to the local authorities etc? If they are actually breaking laws like you said that would be my first step.
 
I'm not 100% sure on this, also not a lawyer etc, but when paypalsucks.com got taken to court, it was found that it's perfectly fine as long as the stories were true and the site wasn't being monetized. So don't stick some adsense or a CPA offer link up there.

Also yeah, you might want to let the local authorities know this is going on.
