Like = Testimonial in their eyes... So, you would need to disclose whether it was paid or not...

Doesn't surprise me in the least, and any form of "social proof" will follow in this same path to be sure!

Recently it was ruled by a district court judge in Virginia that liking something isn't protected by the 1st amendment.

“Simply liking a Facebook page is insufficient,” the judge wrote. “It is not the kind of substantive statement that has previously warranted constitutional protection … For the Court to assume that the Plaintiffs made some specific statement without evidence of such statements is improper.”

You can't have it two ways. If it's insufficient enough to not count as free speech then it's insufficient enough to count as a product endorsement. If the FTC rules that it is sufficient enough to count as a product endorsement then it will be interesting to see the FTC prosecute someone on this, because they're in direct conflict with another court ruling. Yes, I realize the other court ruling doesn't stop the FTC from doing anything, but it will give the defense something to stand on.

Well, I dunno about you guys but I am super excited about this news. I haven't had a good nights rest since FB introduced the like system. Nothing but nightmares and anxiety over seeing something that had fake likes.

America truly is #1. Who wants to setup a donation drive so we can send FTC employees some gift baskets to show our appreciation for their hard and important work? I hope my child grows up one day and becomes a government employee and makes our family proud.

The FTC is just jealous because nobody "Likes" them... We should have seen this coming.

What does this mean for all of the retail stores at the malls now that have huge signs saying something like: "Like us on Facebook for an instant 10% discount"?
