Zimmerman arrested for 2nd degree murder!

lol he is fucked. No chance at a fair trial. They can move the trial to a fuckin small town in Alabama or some shit, and he still won't get a fair trial.

Plus, based on what I've read so far, convicting him of 2nd degree murder is going to be difficult. Seems like prosecution would have been better off charging him with manslaughter.

If I was Zimmerman, right now I would be wishing that they had just arrested me the night of the shooting. Chances are, the case would have got little to no media attention, and he would likely had a fair trial. But at this point? Not a chance.

This case was cherrypicked by the media. There were approximately 15 shootings in the month prior to this incident that had similar cases.

It looks like 2nd degree murder was the correct way to file charges.

via Find Law:

To prove second degree murder, a prosecutor must show that the defendant acted according to a “depraved mind” without regard for human life. Florida state laws permit the prosecution of second degree murder when the killing lacked premeditation or planning, but the defendant acted with enmity toward the victim or the two had an ongoing interaction or relationship. Unlike first degree murder, second degree murder does not necessarily require proof of the defendant’s intent to kill.

why would that make a fair trial impossible?

One quote on the subject:

"It is undeniably a violation of due process to subject a defendant to trial in an atmosphere of mob or threatened mob domination".

Related case law:

Frank v. Mangum, 237 U.S. 309 (1915); Irvin v. Dowd, 366 U.S. 717 (1961); Sheppard v. Maxwell, 384 U.S. 333 (1966).

Not a lawyer, but I assume the defandant could claim that these statements from a sitting U.S. president helped create such an atmosphere:

“You know, if I had a son, he’d look like Trayvon..”

“All of us have to do some soul-searching to figure out how does something like this happen”

Personally, I have no idea what really happened, and so, have no opinion on the guilt or innocence of Zimmerman.

2nd degree murder requires malicious intent under Florida law.

At BEST this is manslaughter.

Police: "Don't Follow him."
Zimmerman: "Imma follow him with my gun."

Dude should have just stayed the fuck home. If he winds up in prison for any stretch he's fucked.

First reason is implied, i.e. the POTUS has no business commenting on individual matters. He should stick to policy and running the country. The second is that besides having no business in general, in specific cases like this one his comments can drastically impact the course things will take and again he has no business doing that.

He said it was a shame what happened to the kid. Not sure how that comment implies guilt for anyone.

Here's what he said:

Less than an accusation, but more than "it's a shame".

Best sentence of this thread so far. I really have no opinion on the guilt or innocence of Zimmerman either, but I do know that it was racially motivated like the media tried to portray it to be at the beginning. They have finally slowed that down because more facts have come out. It seems pretty obvious the government is trying to act in ways to please society though.

First he media shows us pics of some 12 year old kid, people who have no brains think the kid was a 12 year old kid that was shot because he was black.

Zimmerman outweighed him by 100lbs

He looks much larger and probably weighed more than Zimmerman

Zimmerman has no injuries in a police video, clearly he just shot him with no struggle.

the next day his injuries are evident in higher resolution.

ABC edit's Zimmerman's 911 call to make it sound like he was targeting Trayvon because he was black.

Producer is fired,

Because of the media manipulation there have been several Black on white attacks across the country.

I'm not sure what happened that night but a lot of things don't make sense.

On the 911 call Zimmerman says Trayvon is running, he lived less than a city block away, Zimmerman wasn't running after him and you can clearly tell this from the 911 call, because he spoke to the operator for a minute after. He wasn't out of breath and was speaking slowly. Why didn't Trayvon just run home? Why was there a altercation 3-4 minutes after?

Given Trayvon's problems in school, getting caught with Jewelry and such. I don't find it impossible that he was casing homes that night. I don't find it impossible that he could have attacked Zimmerman.

If Zimmerman wasn't arrested the first time, there is a strong chance that there is no case against him.

The problem is now, the media circus has created a environment that witnesses may be scared to come forward.

This guy has a very winnable case, but he will have a very hard time getting a fair trial.

This is the right move, because the State now shifts the responsibility to 12 poor souls who will judge Zimmerman's fate.

If they find him not guilty, then there's not going to be riot's on the streets... just probably a lynch mob going after the jury.

Personally, I think if you're gonna try to convict Zimmerman of anything it should be manslaughter. But then again, i'm not trying to quell riots and appease the public.

Clearly this case was media made. Zimmerman was an idiot for engaging with this kid. IMO his going to get loved tenderly in prison.

End result: Guilty plea to involuntary manslaughter. 2-5 years jail time. Zimmerman still wins cause this was murder.

Anyone care to guess the total cost of damages from the riots when he's found not guilty?

I'm thinking something around Katrina levels.

You really think he will survive jail after killing a kid?

Its every where (tv/internet/people talking about) , no matter what prison he goes to, he will be a victim!

He will be like..."ayy ayy ayy, mi culo".

Protective custody. Same with child molesters, everybody thinks they get turned into bitches when they go to prison, but the truth is the only people getting fucked in prison are the people that want to get fucked when they go to prison.
