Hi,

Basically, how do you feel about doing Trademarked SEO or PPC ? Obviously having other companies logos on your site, and sort of pretending to be them and then beating them in Rank aswell, is unfair competition. But if you arent doing any scam and if the companies products are free anyway, is it illeagal ?

What are your experienced with it, and is it something to seriously worry about ? As in , ive gotten numerous DMCA complaints etc... Should i take all my websites down ?
 


so, you are trying to be/act like a certain company? when you are not the real one?

idk man, if i were one of those companies, I would be pissed. because you would be getting all the credits and etc.
 
Well its complicated asking advice here, when im not describing it to the Fullest. But pretty much ive built a service behind it, and giving away the companys products on my page. So what im benfitting off of , is people looking for that certain company, come to me instead, since i rank before them. Ofcourse id be pissed to, but its called open competiton on the net, what im wondering is, how legal or illeagal is it ? Can i get into big trouble because of it ? Or is it something that is just considered unmoral, and they can complain, but not breaking the law ?

You're giving away a company's products on your page for free. I'm guessing you don't have redistribution rights for whatever this product is?

You've gotta give more details such as the type of product - digital or physical - before anyone can help you.
 
Its all digital. And they have a free version that they offer, among paid versions, im just giving the same free version away and at the backend im selling something else, that is not related to the product.
 
Have you asked your good friend dullspace for advice?

It doesn't matter if they give the product away for free - they likely own the copyright and probably prohibit redistribution, for exactally this reason. Their business name, product name, etc, are probably trademarked too, in which case you will be violating their trademarks and copyright again by using their logos. Also, you'll be causing problems for customers who think you are the legit company, so the real company won't appreciate that either. About the only thing you can do is target their keywords, and offer your service instead.

All in all, it's a bad idea, there is no way they will allow you to do what you originally intended, they are likely trying to sell something too by giving away a free product as a promotion. Just because you beat them in the serps doesn't mean it's okay to assume their identity.

I admire your persistence, but it's not called "Open Competition" when you're trying to fool the consumer into clicking on your site which is not the real company, yet you're giving away their product, too? That's pretty much a lawsuit waiting to happen if you're taking potential money from that company.

But maybe you didn't explain it very well again, so I could be wrong in what you're trying to accomplish. If you're simply trying to rank for a keyword they're ranking for, it's not that big of a deal...but if you're trying to rank for a trademarked name as the keyword - that could be a big deal, especially if you're taking money from their pocket in the end.
