So how does that work? Valueclick gets fined $3m, then do they divide that fine among their advertisers responsible for getting them in trouble?

Hi-speed media which was a big mail shop was acquired by VC - primarily due to it's mail revenue. I *believe* they were also running their own products. So this isn't exactly the case of an innocent network getting bent over due to unscrupulous emails touting "free" products.
Not when it's your mail going out- and likely not disclosing "free" statements (especially if it's then hitting YOUR sales page).
So to the OP a real apple
range scenario with affiliates cranking out 'free trial!' landing pages and pushing acai- they'll be going after the MERCHANTS not the affiliates. At least that's my view.
Of course this doesn't take into consideration the complete tards making wildly wreckless false statements.
