If I were to register a domain like e-bay.com, for example, and redirect that to ebay using my referral link, could I get in trouble? I know ebay would find out right away, but with smaller, less experienced companies, is this something I could get away with? could I be sued for trademark infringement?

Best case scenario - you get a C&D email
Good case scenario - you get WIPOed
Worst case scenario - you get sued.

They will probably also notify your affiliate network or remove you from their program.

Over the past several years I got mostly (~15) C&D emails and 1-2 WIPOs

==> Use domain privacy + fake whois

Even if you use fake details, they can simply tell the registrar that this has clearly been registered in bad faith, and as a non-communicative party, they'll request the registrar either cancel the domain from underneath you, or hand it over to them.

Registering domain typos and using them for a purpose like this is clearly a "bad faith" registation.

Yeah, I think the important issue here is to identify the motives for registering such a domain.

In the scenario you mention, you are attempting to benefit from ebay's 'status', and the probable outcome would be them contacting the registrar to take it down.
