Network not paying, how to pursue legally?

So there's a network that owes me around 9k, and they are not paying me because the advertiser isn't paying them. There was nothing wrong with my traffic. They keep saying they will pay me when the advertiser pays them, and it's already been like 3 months.

As an affiliate from outside the US, what would be the best way to pursue this?

9K is worth the chase imo. "advertiser isn't paying me so I can't pay you, yes your traffic was fine but..." < Fuck that. You're probably screwed thx to their TOS/SA/T&C/BS!/but I'd still try (and be creative with how you get it back/them back). Can't believe the CPA world functions like this most of the time where the middle man takes all responsibility but no risk themselves... It sounds like it's a bigger network too or you would have outed them already.

I'm part moron for running traffic to them, I had my suspicions initially. So I sent less than $1k a month for around 3 months. They paid, so I ramped up my traffic and now this...

Any recommendations for lawyers?

Yeah I thought they valued their reputation a bit more, and value affiliates who could promote offers other than email submits via polls... Guess not.

Apparently something should happen before the end of the week, but I've been told that before also.
 
They are not paying simply because they were not paid?
Damn i'd be pissed. That's not your problem.
One of the reasons you signed with the network to be sure that if the advertiser did not pay, you won't be stuck out...
Hopefully the network is substantial enough to pay you and then sick their lawyers on the advertiser to pay up eventually.. I guess they are not.
 
Chances are the agreement you signed says they dont have to pay you until they get paid. There isnt much you can do here, i am sure Wotogopa is trying to collect but the continuity space has a lot of shady advertisers and if a network doesnt screen them good enough they can get stuck in this position if they dont have the cash flow to pay it and fight the advertiser. I would chalk it up to a learning experience and continue to try and get paid but dont be to hopeful about it
