Military given go-ahead to detain US terrorist suspects without trial



Thank you for contacting me about the National Defense Authorization Act for Fiscal Year 2012. I share your concern about provisions of the bill dealing with detention policy.

I joined 98 other Senators in passing an amendment to the defense bill reaffirming that we cannot hold U.S. citizens indefinitely without trial. Because I believe our national security professionals should decide the best way to detain and prosecute terror suspects, I also opposed provisions of the bill that would allow only the military to handle terror suspects captured in the United States, but efforts to change that language were unsuccessful.

A joint Congressional committee is now working out differences between the Senate legislation and the version of the bill passed by the House of Representatives, including the provisions relating to detention policy. Both chambers must then approve the final text before it goes to the President.

I will continue to monitor this issue closely in my work on the Senate Intelligence Committee, and I will keep your views in mind.

It is not as big a leap for politicians as some citizens believe. From Greenwald:

First, while the powers this bill enshrines are indeed radical and dangerous, most of them already exist. That’s because first the Bush administration and now the Obama administration have aggressively argued that the original 2001 AUMF already empowers them to imprison people without charges, use force against even U.S. citizens without due process (Anwar Awlaki), and target not only members of Al Qaeda and the Taliban (as the law states) but also anyone who “substantially supports” those groups and/or “associated forces” (whatever those terms mean). That’s why this bill states that it does not intend to change the 2001 AUMF (even as it codifies far broader language defining the scope of the war) or the detention powers of the President, and it’s why they purposely made the bill vague on whether it expressly authorizes military detention of U.S. citizens on U.S. soil: it’s because the bill’s proponents and the White House both believe that the President already possesses these broadened powers with or without this bill. Passed a week after 9/11, it states (in part):

That the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.
Pretty broad, right?

Yup and as I recall the initial language that they didn't get the first time around said something like 'anyone, anytime, anywhere, for any reason we declare related to any terrorism, not just 9/11'. Good times.

They ended up getting it all anyway between the patriot/military commissions/john warner defense authorization acts. This most recent one closes up more of the loose ends. Pretty much everything to get a full on police state ramped up is now on the books here in the good ol us of a.

I heard somewhere that for the first time some military have recently been put on short alert for manning some of the detention centers that have been built/rehabbed since Rex 84/FEMA CoG etc. Pretty sketchy.

Think of the silver lining. The first group to be labeled as "domestic terrorists" will probably be the OWS crowd, so at least we won't have to listen to people bitch about OWS so much.

Then just wait until some nut job Christian fundamentalist gets into the White House again, and all of a sudden the US will be rounding up all Muslims. Or if the US does actually invade Iran, American-Iranians will almost definitely begin disappearing off the streets, just like the Japanese in WWII. Worst part being, millions of people will think that's an excellent idea!
