Case dropped against millionaire accused of running over cop’s foot with his Ferrari | New York Post

“We demonstrated that the contact was incidental,” Brafman said. “The police officer claimed the car ran over his foot, but you can see it in the video — the car lurches an inch or two forward, and grazes the pant leg of the officer.”
As for why the car moved forward, “It’s a Ferrari — it almost moves by itself. You wouldn’t believe it,” Brafman told a reporter.

Lol, as if someone with money is ever going to get convicted of some bullshit charge like this

The guy is still a twat. Driving off whilst the cop is in the middle of writing a ticket, yeah, like that was going to end well.

That Lower Manhattan hipster deserved to get the shit kicked out of him by the cop.

The outcome was expected though, in the epicenter of Capitalism, cash rules.

He is allowed to drive away if he is receiving a ticket while his car was standing still/not moving. If he was driving and pulled over, then yes, he would need to pull over until he is given the ticket and told by the officer to leave. It happens all the time, the ticket is just mailed to the driver's home. The officer decided to become an ass when he intentionally placed his body in front of the vehicle and his foot near the wheel.

Now if the officer said that he has to detain him while he finishes writing the ticket, then the driver was required by law to sit in his vechile in wait. If such an exchange never happened, then off he is allowed to go. When an officer pulls you over, he is allowed to detain you for 15 minutes until new evidence comes in light for further investigation. Such as if he smells weed in your car and decides to bring in a dog...then he is allowed to keep you on site for as long as he needs to complete the investigation.

From the article:

“The video clearly shows the car running over my client’s foot,” Strazzullo said. “Thank god my client wasn’t hurt more,” the civil lawyer said. “I mean, my god, it’s a car.”
What a joke lol. The car never went over his foot, and at best just pushed up against it.

If anything, I would sue the officer for smacking the window and denting the car door on the taxi.

At the end of the day, both parties could have behaved better. The driver should have just accepted all his non-moving violation tickets and then hauled ass out of there. While the officer should have never stepped in front of the car and shouldn't have become so aggressive.

Seriously though...

That cop was out of line.

Did not maintain his cool at all and purposely put his body in front of the car.

CLEARLY the kid was going to move the car out of the no parking zone.

MGrunin been had made good points; I agree.

Keep in mind that if he is a meter maid, then he has even less authority. He cannot detain you, and he cannot write any tickets outside of parking enforcement.

Quick google search, and here is an example:

Parking Ticket - California - Giving tickets after the fact? - Slickdeals.net

Person was parked illegally. Saw a cop make a uturn and stoped near his vehicle. The driver just got back into the car and drove away, he was then mailed a ticket several weeks later.

Here is an example of a Meter Maid actually covering this exact circumstance

You wrote that jumping into your car and driving away won't work in avoiding a ticket, but what if I pull away before the officer has finished writing it up, thus preventing him from "serving" it to me? Aren't I home free then?

I stated earlier that if it isn't served to your vehicle your home free, but jumping into your car and driving away isn't always the best solution. It's rude and and it's dangerous because your main focus is to avoid getting the ticket and you may not notice other cars, cyclists or people around you. It is also dangerous for the officer as well, as some of my coworkers have been hit by doors, had their feet run over etc. because someone was in a rush to get away from them. What I mentioned was that it is simpler for you to actually say "Hi, I'm here, I'm leaving" rather than attempting to drive off.

---

So again, it might be fucking rude or dangerous, but it is NOT against the law.

While the officer should have never have become so aggressive.

Officers do not become aggressive. They are simply doing their jobs. He was just trying to detain the suspect, and get out alive. Sometimes an officer needs to assert his god given powers, and subdue a violent offender. Sometimes criminals don't corporate, and sometimes these criminals get injured.

What criminal? your innocent until proven guilty. That officer's conduct is unbecoming of an officer and unprofessional.

I've had cops pulled me over for BS before. I remained calm, respectful, and explained to him how his interpretation of the event was inaccurate thanks to x, y, and z and how, because he pulled me over, he is doing ______. I then told him to call his sergeant over so I can speak with his sergeant. After I had a nice chat with the sergeant, I could see him chew that officer out.

tl;dr: cops are afraid of you if you know the law because, unlike you, if they screw up, they lose their job/bring shame upon their department and profession/getting sued.

This guy, all be it a little rude and dick-ish, knows how to give it to the cops.

I like this guy, well not really. But I like when people get away with shit. So gratz to this dickface for getting off.

Maybe next time ROBO Cop will think twice before putting his hoof under a cars wheel.
