How to take advantage of unregistered domains...

I found a few site that sell stuff on the web, some of them have "brandable" names, but didnt register the .net domains... for example lets say that www.pencildaddy.com didnt register pencildaddy.net...

How would you exploit this ?

I can think of 2 things... first look to see if they are offering an affiliate program, in which case, you get the .net ... You seo your site to comme out for the brand name, when someone does a search for "brandname" they might find your site and there see an exact copy of the site they were looking for, except most link will point to the .com and I get commission if they buy anything...

Second option is to take the .net and create a website which target the same market and offer similar product...

Any ideas ?
 


Both are viable ideas, as long as you're not stepping on anyones copyright or trademark toes. Try 'em and see. That's the only way you'll know if it'll work and be worthwhile.

I wouldn't duplicate someone elses site to use it for an aff. program.

Either way especially if its a "brandable" domain your fucked. If its not a generic name they have 100% legal right to take that name away from you unless you can prove that your never have/had any intention of profiting from their "brand" and good luck with that.

Yes some people make money with parked TM domains but most of the time if you are going to be trying to monetize it with affil programs or whatever you'll just get served with a request to give them the domain.
 
So i cant buy pencildaddy.net even if they are an online based company only ? what would happen, they ask for it, then what , i could sell it to them ? or do i have to GIVE it to them ? How about if im affiliating with them... in a way it would benefit them too because they make more sales thanks to me ?
 
This is more commonly done in the reverse, checking for available .com's with developed .nets

Yeah, I've got the com of a small hosting company that uses the .net. Got it just going through their affiliate program and until a few minutes a go was happy with the sales I was getting for doing nothing.

...Just tried to request payment and they've told me the sales were an error, their system assigned phone orders to aff id 001 (wouldn't surprise me if I'm their only affiliate). Fuckers. (Anyone wanna buy quicklyweb.com?)
 
You'd have to give it to them if they have copyright or trademark on the name.

You can't copyright a name. Chances are pencildickdaddy.com didn't drop the $6-hundy plus for a tm either, if they weren't worried enough to register all the other TLDs for their name. It's easy enough to look up on the uspto website.

Could they sue you? Sure, we live in a litigous society where anyone can sue anyone else for any reason. Would they? Not likely. Lotsa money to sue someone. (see above)

What MIGHT happen? Maybe a C&D letter, maybe a note to your hosting provider, your registrar and maybe to G. You MIGHT get your domain yanked by your registrar, you MIGHT get your hosting account suspended or, you MIGHT get delisted in G.

Whoop-dee-freakin-doo! What's the worst that can happen?
