so i work for this newspaper company. quick brief....some idiot ripped our newspaper site Balita.com, For Fil-Ams anywhere, You'll find us everywhere and created Home | Balita News. he's been slandering one of our lawyers with offensive remarks etc...amongst other things.

found out thru whois this guys site is hosted with Domains by Proxy so we're unable to track this guy down, we were able to send notice to the hosting provider to shut down the site but to no avail as of yet.

is there a way i can track this guy down?
 


hmmm...so you did a whois on the hosting site and they have 5 other domains listed with this company? not sure where your going with this...
 
call them up and ask - sometimes they can be more forthcoming with the private whois data than people care to imagine..
 
I couldn't even access the copycat website you posted, apparently an error with their mysql server. and dxmhosting is a local business - it's either operated by the same person, or they know who. You can get their contact info by a whois on dxmhost.. have an attorney send them a strongly worded letter and I bet they fold quick. people tend to feel invisible on the internet, but once something reaches them that is real, things change.

and the slander part.. you mean this website?

You won't be able to take that site down just because it's (allegedly) a "rip-off" of your own site...
You could maybe have the post at the top of the site removed that talks about "Gary Escarilla" for being slanderous - but it could get tricky and costly.

There is something in place that protects the website owners from having to remove content from their site. - All the owner of the "balita-news.com" website would have to reply would be "This is unmonitored user generated content".

How do you think websites like ripoffreport get away with not taking the slanderous (and at times derogatory) content down?
 
What you can do is complain to the IP provider (not the hosting company) - and most of the time they don't want to get into any kind of litigation, so they'll contact the hosting company and tell them that they are getting complaints of a website hosted on that specific IP block - the hosting company will normally find a way to remedy the situation by either moving the site elsewhere or asking the customer to find somewhere else to host the website.
 
Just to be fair and even with both sides... (cause i'm an "equal opportunity advisor").

Worst case scenario, all the owner of "balita-news.com" would have to do is move his website overseas. (panama, etc) - and there will really be no way you could take him down. - you'll end up spending a lot of money and getting absolutely nowhere!

If you're worried about the negative results that come up when you search for a specific keyword related to your website/company, I would suggest paying an SEO company to get that information pushed off of the front page of the search results.
