Experian Consumer Direct Teams with LashBack to Enforce CAN-SPAM Act

LashBack provides Experian Consumer Direct with information, tools and technology to help manage responsible e-mail marketing by partner advertisers

Irvine, Calif. — Experian Consumer Direct, a leading provider of online direct-to-consumer credit reports, scores and monitoring, today announced that it has joined forces with LashBack™ LLC, an e-mail reputation provider, to monitor partner advertisers’ compliance with the Controlling the Assault of Non-Solicited Pornography and Marketing Act legislation (CAN-SPAM Act).

The CAN-SPAM Act requires that U.S. advertisers provide a working unsubscribe link in every commercial e-mail message. Consumers are instructed to follow this “opt-out” link to be removed from that particular mailing list. Under the law, the e-mail sender has 10 business days to stop sending commercial e-mail messages to that consumer. A violation happens when an e-mail sender fails to remove consumers who have unsubscribed from its e-mail list or when e-mail senders do not use suppression lists provided by the company that is advertising the product or service.

“Responsible e-mail marketing is a serious and important issue for Experian Consumer Direct, and we are proud to lead the cause by partnering with LashBack,” said Ty Taylor, president of Experian Consumer Direct. “Using their data and technology helps us choose better partners and allows us to actively review the e-mail marketing process for compliance and hold our advertising partners accountable. Consumers who receive our offers and choose to unsubscribe to future e-mails can do so safely. We will continually monitor and enforce their preference.”

“We are helping build accountability and consumer trust into the unsubscribe process by alerting Experian Consumer Direct immediately when we see a potential violation of the CAN-SPAM Act,” said Brandon Phillips, chief executive officer for LashBack. “By using our UnsubMonitor™ service, Experian Consumer Direct’s e-mail offers can be trusted by consumers who receive them. In addition, we help get their e-mails into the inbox of interested consumers without being tagged by Internet service providers as spam.”

The benefits of partnering with LashBack include helping with CAN-SPAM Act compliance, increased deliverability of e-mails, consumer protection and corporate brand protection. LashBack unsubscribe reputation intelligence and automation services are used to protect millions of consumers’ e-mail accounts. As actual consumers report messages to LashBack for unsubscribe processing, LashBack tracks and records the outcome of those unsubscribes. That track record of “success versus failure” is the baseline for the senders’ reputation, which in turn impacts deliverability at many of the largest Internet service providers. The end benefit for consumers is to stop unwanted e-mails after they have unsubscribed.
