Can you get out of a contract if your partner has done jail time?

I had a past partner who has served jail time for scamming health care companies few HUGE amounts (400k - 2 million). Served 30 months then had to serve the rest of his 12 years because he didn't pay back restituition like he was suppose to.

Things to note:

- happened before the partnership started but didn't disclose this to me
- hurt the business as everytime someone googled his name, past court cases + blog post about how he scammed these companies comes up
- past partner is now suing me for leaving the business once I found out about all this past stuff (he's still a dick, but i did sign a non-compete).

I'm not looking for legal advice i'm looking for any experience on the subject or maybe a similar experience and what happened if anyone has one. Can't find anything out there on Google on this.

EDIT: The question is about the Non-compete I signed, which is the main thing he's trying to sue me for.

The keys will be what state you are in, and what the non-compete says.

In many states, non-competes aren't worth much more than the paper they are printed on. Unless, there was consideration give for it. Sometimes they can be a GREAT hindrance. There are way too many variables for anyone to give you generic information.

BTW, I am not a lawyer, and especially since he has already started action against you, a lawyer is who you should be talking to. It may cost you $500-800 to get a good answer and begin the process; problem is finding a good lawyer.

BTW2, One of the first questions that will be asked of you is: How much money does he have?
