i haven't found this answer elsewhere and i've searched elsewhere also.

i am taking over a client's website, to do some seo & help him get more out of it. i talked to him about 2 years ago, and he used to be ranked in the google top 5 or 10 for most of his big brand name items, and was selling a ton of stuff online; his traffic now is minimal.

when i contacted his former webmaster to get the log/pass info, we started bs'ing about this horrible site i am taking over(it really looks like shite on a stick).
he told me that somebody else was doing work on it for awhile and got this site blacklisted by google(same color text/background all over the place, other stuff google frowns upon, etc.).
the former wmaster said he would recommend a whole new domain and website, because google took a year to give him that info & they may not ever take him off of their blacklist.

inputting his domain name in google, he desn't even show up in the top 100!

is there a way to find out if a site is truly blacklisted, like a list or something? or is it pretty obvious from what i've stated?
does google look at the registrant, ie: would they maybe blacklist a new similar domain because of the ownership?

Explain you believe your domain was blacklisted due to an error in your apache configuration which violated Google's terms of service. Works for me every time.

i also found this in the root today in a txt file:

IF YOU DO NOT STOP SPAMMING OUR E-MAIL GROUPS WITH YOUR OFFERS FOR ********
CRAP, I WILL VISIT YOUR ISP AND TELL THEM YOUR USING YOUR WEB SITE TO SEND
SPAM. THIS IS ILLEGAL AND AGAINST RECENT CHANGES IN THE LAW.
