I don't think fake testimonials can ever be killed. It's just a matter of toeing the line and not promising anything too rediculous. You'll have to find creative ways to make the truth sound way more exciting than it is.

Because the guidelines are still a work in progress. They were set to be released 100% this summer sometime, so time is winding down.

Dude, it's the law. It's open to interpretation. People will think their company is following it, and sometimes the FTC will *ahem* disagree.

But read the guidelines. I gave you a link that has literally EVERYTHING that is publicly available on it. Read. Don't ask. Read.

Definitely. But what most affiliates don't realize is that ultimately they have the same level of liability with regards to making claims. The enforcement hasn't caught up to the FTC rules yet but it's bound to happen.

I think it's going to be tricky. If someone has a legitimate, first hand experience and posts something saying as much, it's solidly within the first amendment. The idea that someone would have to worry about legal liability for posting their opinions and direct experience is pretty foreign to me, and I think would be pretty quickly struck down.

But at the same time, the environment we exist within now is obviously not going to keep going. The future of it all I think will be determined by how broadly the FTC chooses to interpret their own guidelines, and how aggressively they decide to pursue them. If they step over the first amendment and a court rules as such...it only takes one court case to set a precedent that strips them of a lot of their power in this.

We're all (us and the FTC) going to be towing a fine line. We'll just have to see who crosses it.
