I run a pg rated forum. And today, one of the users sent me some info about another user. Turns out the dude has been convicted of "800.04 Lewdly Fondle Or Assault, Commit Or Simulate Sexual Acts On Or In Presence Of A Child Under 16 In A Lewd, Lascivious Or Indecent Manner". Not much info aside from that.

A large part of the community affairs involves exchanging home addresses for raffles/swaps/contests among users in addition to buy/sell/trade with tangible products. So people constantly exchange their personal info.

I can already see a big problem with this guy asking others for their home addresses because one of the products he is offering is related to children.

I would like to kick him off the forum, but I'm not sure if he can sue me for discrimination or anything else if I do.

I've kicked people out before for various reasons, but this would be different. I wouldn't be kicking someone out because they broke forum rules but because of "who they are". Not sure about the legality of this.

Any thoughts?

I really don't want to consult a lawyer over this.
 


Pretty sure no court is going to give a fuck if you ban him. It's a private forum (you own it), which means you can ban him for breaking any number of your rules.
 
Oh, gawd. Worst nightmare. I am a new mom and that info is very disturbing. Please kick him to the curb. He's the biggest scum bag.

On the flip side, how accurate is the info? I have a friend on the sex offender's list because he peed on a tree when drunk. He was celebrating and well, he had to do his thang and got busted. That is hardly as horrid as other offenses.

I mean, what are the facts here?
 
Yeah it isnt going to be a big deal, but is this some sicko or is this some guy who got in trouble at 17 messing around with his 15 yo girlfriend?

Yeah, that's the biggest problem with sex offender registries. I've heard of people who got screwed by the system for public urination and there is no way to distinguish them from real rapists/predators.

As I said before, there aren't any facts other than his profile in the sex offender registry. It states what his was convicted of, but not the actual facts. I'm pretty sure the case has been sealed.

Well, not exactly. I can't ban all blacks, or all jews, or all republicans. There are several classes protected by the anti-discrimination laws.

Of course, being a sex offender doesn't make one fall into a protected class, so I'm not worried about a straight and simple discrimination suit.

But I just want to make sure he can't sue for some related shit, like "reputation"... "income", etc. because he sells some products to my audience.

Oh, you don't know him.

OP: Could simply be a disgruntled member making this accusation, so make sure that you know for sure whether or not he has been charged. If he has then it would probably be in your best interest to get rid (and maybe report him).
 
Just make up any old reason to ban him, like say he was spamming or some shit and be done with it if you are worried about getting in trouble for banning a pedo.

You can ban every group that you listed. Protected classes and anti-discrimination laws do not apply to your online forum.

Do you think the stormfront forum is required to let black people register and stay?

Hmm, interesting. Why not? If those laws apply to other forms of private property, why not to forums if a forum is considered private property?
 
Honestly dude don't even sweat it.

Don't tell him your gonna ban him because he's a pedobear, don't tell him anything at all.

Just ignore all his emails and ban his IP, email, user.

If you are ever asked by a lawyer to provide information you can tell them that at the time your logs indicated the IP was producing a large number of spam and was automatically blocked. When they ask you for information, tell him that you don't save that sort of thing.

Another option is to move your forum to an offshore server (unless you are already) and then you can pretty much do whatever the fuck u want.

I think we consider forums to be more akin to your home. You can exclude anyone for any reason (with some exceptions, of course). Places of business, on the other hand, cannot exclude the people you mentioned above, which is what you may be thinking about.
 
So how exactly would this person know if they are really a pedo? Accusing someone of being a pedophile is one of the oldest, most effective way of harassing someone and getting people prejudicial to someone.

Just look how in this thread some people think it is actually true at the earliest accusations without even knowing the case or that this is the exact same person. How many people are there in this town with this exact name?
