The thing is hard to argue. Yes we protected by the DMCA for content. It is just a file sharing site. People were arguing it was hard to find these files, so company can't send a DMCA to everything. He knew that most of his income come from pirated files (but megaupload is huge and hard to manage).

If they get a jury full of 40+s that are computards then they'll have no problem sending him to jail for life. If he can get half the jury full of tech savy <35s then he might walk away.

He probably was within the law as far as take downs and such go, but we all know that's irrelevant. The law is manipulated as needed to suit those who have the power.

Every DMCA I ever sent to MegaUpload was handled within 24 hours. We're talking at least 3 dozen over the last two years or so. RapidShare and especially MediaFire are also really fast.

Another point I'd like to add is, very few people on this planet know what it feels like to work extremely hard creating something to just lose everything. I can only imagine how empty he must feel. At least he still has some freedom and his family left. I wish Kim all the best of luck for the future, and I hope he fights this to the bitter end.
