Ok I am going to spill out all of the facts for you on how Market Leverage jerked me around over $22k+. First off, I'm a mailer who does solid numbers every month with multiple CPA networks. Xy7, CPA Emp, Adsolutia, Incenta, Hydra, CB, MaxB, all love my traffic. All of these networks have catered to my needs and have done a wonderful job of providing excellent service. Unfortunately Market Leverage is the absolute worst CPA network I have EVER! dealt with.

The issue is over a Harry and David giftcard I mailed exclusively for ML over the weekend on June 8 - 10th. Apparently ML got a complaint from their advertiser and said fuck you, we aren't paying you anything for that traffic which amounted to over $22k. (Keep in mind that these are perfectly good leads.) The complaint was over me modifying the creative on the Harry and David card. ML claimed that they did not get paid a single dime from the advertiser because the AD looked "deceptive". (I can post the exact ad I mailed here and let you decide if needed.) When I asked who the advertiser was, they responded: confidental. I have had circumstances like this happen before on other networks, and I have ALWAYS been paid for the traffic. I have a REAL hard time believeing that they didn't get paid for my leads.

Phone Convo with Sal on Monday June 11th

I talked to Sal of Market leverage on the phone thinking there would be some type of resolution to this problem. Even if there was a slight decrease in the amount per lead, I could work with that. I don't think I've ever talked to a more rude arrogant prick than this fuck. He was talking about all this BS about how he was honest and one of the "good guys" in the industry. Sal said he didnt want to work with me on this and wasn't even going to TRY to pay me on the leads. The message I got from the conversation was, fuck you Jason your not getting paid.

The next day when everyone seemed to cool their jets, I talked to my AM at POS ML and he propsed a resolution. The resolution was that they would give me the full price per lead, 15% more than I was currently making, for a week or two to make up the loss. So I'd get paid 100% on all leads and ML would get nothing on my leads for about a week. Yes, after everything that happened they now wanted my traffic. My counter was bumping up the rest of the money owed to me, ($16k+) to full price per lead. This amounted to a raise of about $4k. YES ML HAS A BALANCE OF CLOSE TO 40K THAT THEY OWE ME. I reluctantly agreed to these terms as to cut my losses as best as I can. Sal explained to me that this advertiser has him "by the balls" and there isn't much he could do about it. I dont see waht the big deal in dropping the advertiser is. If they are fucking people over why would you want to keep them anyway?! This conversation was much different than the one we had the other day where he said he didn't want to work with me on the situation. Interesting...I sent over an AD for ML to approve, as to not cause anymore issues and started up my mailer Thursday night running one of my ads. I was for a couple of days because of an issue with my domain registrar.

As part of the agreement between me and ML, a wire would be sent out on Friday for the 16k+ I was owed for other traffic generated during the month. This amounted to $20k+ because I was getting full pop on the leads. However when I contacted and asked about the wire, ML said that they didn't feel a wire should go out because of the amount of traffic I was currently sending. KEEP IN MIND I WAS DOWN FOR 2 DAYS AND WAS CURRENTLY MAILING ONE OF THEIR OFFERS!! I CANNOT BELIEVE THESE FUCKERS!! I pretty much said fuck this bullshit send me my damn MONEY!!! MARKET LEVERAGE AGREED TO SEND ME $16.5K ON MONDAY JUNE 19TH, YESTERDAY!! I bugged them all day yesterday about this and my AM said I would have my money by 5pm Eastern Standard Time! I contacted them today about the issue and got this responce, and I quote,"accounting doesn't want to send until we are square with advertiser payment...they will send Net 15, i had a meeting with them last night."
Well what do ya fucking know, ML screwing me around again?? Say it aint soooo...I have the AIM logs to back up my conversations with Market Leverage. I will post them as needed. Also have a SS of my stats.

These guys NEED to be banned. I am going to get paid on the 16k+ im owed and pursue legal action on the 22k. I have laid down all the facts on what exactly took place. These guys are the most disrespectufl scummiest POS on the CPA planet! They cant get away with scamming people out of money like this. AND BELIEVE ME! I AM NOT THE ONLY ONE. I'VE TALKED TO OTHER PEOPLE WHO'VE HAD PAYMENT ISSUES ON ML, SOME ARE ON THIS VERY SITE! I'll leave it up to them if they want to respond since they have significant money owed too. I have been biting the proverbial bullet par say the last few days; holding back from posting this in hopes payment could be worked out. I feel this information needs to be made public, so here it is!
Lets hear it WF members. WHat do you all think about this? SHould ML be the 2nd CPA network banned? I say FUCK YEAH. I'll let you all decide. Better yet, ML what do you have to say over these alligations?
 


I feel your pain.. as a fellow mailer I have had similar issues.. late payments.. horrible service.. and now reading this I am scared to death to run any more traffic through them.. I wont go into specifics since I still have money on the table with them.. but I feel your pain. For those of you out there looking for alternatives.. here are my top netoworks I mail through.. I havent had a single problem with any of these guys..

Marketleverage runs a lot of offers through other networks.. you are better off going Direct with Hydra to get the offer.. Or Incentalcick who lately have been my fav..

That is so frustrating, tell them to pay you want they owe you or you are going to send the emails again and in the email blame the company for being scammers!
 
That's shit man, def pursue it if ya can... not sure of US laws... breach of contract? Some shit like that? If ya fight it they've got more to lose by the negative publicity of a court case. I take it if it did get to court they would have to disclose their accounts?

I vote ban also. Skrilla is definitely one of the good guys, he's proved that outside of this forum (I won't say how). Suffice it to say, he has a big heart, and what ML is pulling is complete bullshit.

Funny thing is, $40K paid to one mailer will look like peanuts next to what they'll lose by tarnishing their reputation in this manner. Wickedfire is growing everyday, and the number of people that read it far exceeds the membership numbers.
 
Let change their ad creative to LET NO PAYOUTS EAT YOUR PROFITS, NO MARGINS = NO PROFIT
 
Does sound bad... but what kind of understanding did you have with them on modifying creatives before then?
 
It sounds like a pretty frustrating experience overall. After everything a company like that does to recruit affiliates - to get one and then treat them this way is astounding.

I wouldn't mind seeing the creative in question, just to get an idea of exactly what "deceptive" was in the eyes of these guys. I've run a handful of campaigns that I think push the envelope but have never caused me trouble.

Anyways, hope your lawyer isn't TOO expensive. Good luck.

There was none. They never said I couldn't modfiy to get rid of the spammish words that get nailed by filters. They loved my traffic and so did the advertisers. Apparently, they said its in their Terms of Agreement that I couldn't do it. You be the judge. read over their TOA and tell me what you think. Its a vague outline. Basically what I got out of it is they terminate your account for no reason at all.

Hi everyone..My name is Mike Kelly and I am the affiliate manager at Market Leverage who is responsible for working with skrilla. First off…I believe this post really distorts the issue and want to make sure everyone knows what happened.

In an effort to increase the amount of publishing skrilla did for MarketLeverage, I reached out to him in June and gave him the exclusive on a promising new Harry and David campaign. From our perspective all was going well and skrilla was scheduled to receive payments on a weekly basis as a result.

Three days into him running the campaign we received an alarming phone call and fax from the advertiser which showed that skrilla was using an unapproved creative, from line, and subject line which aggressively created the impression that the email recipient was already being sent a Harry and David Gift basket and that they needed to provide “Gift Delivery Confirmation”.

Like many of you….we have seen many variations of marketing etc. over the years…some advertisers are more aggressive than others…what is ok for one may not be for another. That is why there is Approved Creative. The issue here is that skrilla altered the creative in significant ways without getting approval from us (and us in turn from the advertiser). MarketLeverage is very clear about not altering ads…we have to be because advertisers can and do hold back payments when people change the advertising beyond what is allowed.

A few more points:

  • MarketLeverage will not receive a single penny for the 22k in traffic Skrilla generated. Yes, it is true that the advertiser probably made some money…but we do not want to be a network where people distort creative and we or they profit from it. The best way for us to be a great network is to work hard at providing great ads at great payouts and to partner with publishers who either run approved creative or work through the right channels to get creative approved.
  • MarketLeverage received a legal notice from Harry and David as a result of skrilla’s campaign. We have since had to take the ad down after making it available to other publishers who did nothing wrong.
  • As skrilla pointed out, we tried to work with him after the issue with this campaign by giving him full payouts after this issue arose..we did this because he promised he would no longer change ads without approval…we took him at his word.
  • We are not refusing to pay skrilla for the other campaigns he did with us (16K). I admit that I did tell him we were going to pay him for this on Monday. After others in the company saw the issue that was created with Harry and David they decided to pay skrilla net 15 in case any other issues arise as a result of is past traffic.
To summarize, ML has never not paid a publisher in 3 years and through millions of CPA transactions unless fraud or creative distortions took place. There have been many instances where we have paid publishers despite not receiving payments ourselves. Publishers have a right to be paid on legit traffic and advertisers have a right to expect that their creative and message are not distorted by publishers. Fortunately, the vast majority of our publishers and advertisers understand this and have formed good relationships with us.
